Probate and Estates
Probate in Florida is a deeply diverse subject matter that includes administration of decedent’s estates, homestead determination, guardianship, and mental heath. Estate planning is closely tied to probate, as it is commonly used in conjunction with planning to aide in the ease of administration, or to avoid administration all together.
Of all the areas of law, probate is possibly the most likely subject matter that every family will deal with at some point in their lives. All of the areas of probate can be very confusing without the help of experienced legal counsel, and in the instance pf administration of estates, a lawyer will be required by the courts.
Further in the case of homestead determination and administration of estates, it is crucial to make sure that the case is handled correctly. The outcome of these types of cases can have serious impact on real property, and if done wrong, further proceedings may have to be undertaken to correct mistakes to clear title.
Complex rules and notice provisions must be followed in all these cases. A mistake in procedure can cause the case to be challenged at a latter date and lead to significant uncertainty, and is some cases, serious legal liability.
